The City and County of Denver (City) appeals the trial court judgment awarding attorneys fees to plaintiff, Donald O. Collier, pursuant to 42 U.S.C. Â§ 1988. The City contends that the trial court erred in that plaintiffs allegations of simple negligence in the training, supervision, and retention of a police officer failed to state a claim for relief under 42 U.S.C. Â§ 1983. We agree with the Citys contention and, therefore, reverse the judgment of the trial court.
